1.2. Governing Law and Jurisdiction
 
These terms & conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts.
 
1.3. Your Account
 
If you use the web site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.
 
Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. You can access and update much of the information you provided us with in the ´My Account´ area of the Web site.
 
Little Lollypops Ltd reserves the right to refuse access to the Web site, terminate accounts, remove or edit content, or cancel orders at our discretion. If we cancel an order, it will be without charge to you.

We will do our utmost to ensure that availability of the web site will be uninterrupted and that transmissions will be error-free. However, due to the nature of the internet, this cannot be guaranteed.
 
Also, your access to the Web site may be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.
 
1.5. Events Beyond Our Reasonable Control
 
We will not be held responsible for any delay or failure to comply with our obligations under these terms & condition if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

2. Your Order

2.1. Placing Your Order
 
Making a purchase is easy. Just follow these simple steps:

• Shop by browsing through the required category or by using our shop by brand feature.
• Click on the image to access the individual item´s product page.
• Add merchandise to your shopping bag by clicking on the ´add to shopping bag´ button near the desired item.
• To delete an item from your shopping bag, click on the ´Remove´ link next to the item´s price.
• Please be aware that when the item is in your shopping bag another customer can still purchase it.
• Proceed to checkout to finalise your purchases and follow the instructions.

2.2. Eligibility to Purchase
 
The purchase of merchandise through Little Lollypops Ltd is strictly limited to parties who can lawfully enter into an form contracts on the Site in accordance with English law.
 
In order to make purchases through the site, you will be requested to register and provide your personal details. In particular, customers must provide their real name, phone number, e-mail address and other requested information as indicated. Furthermore, when ordering items, you will be required to provide payment details and you represent and warrant that the payment details you provide on ordering are both valid and correct and you can confirm that you are the person referred to in the Billing Information provided.
 
Little Lollypops Ltd sells children´s products for purchase by adults. If you are under 18, you may use our site but only with the involvement of a parent or guardian.
 
The site is available only to individuals and others who meet the Little Lollypops Ltd terms of eligibility, who have been issued a valid credit card by a bank acceptable to us, whose applications are acceptable to Little Lollypops Ltd and who have authorised Little Lollypops Ltd to process a charge or charges on their credit card in the amount of the total purchase price for the merchandise which they purchase.
 
Moreover, by making an offer to purchase merchandise you expressly authorise us to perform credit checks and, where Little Lollypops Ltd feels necessary, to transmit or to obtain information (including any update information) about you to or from third parties from time to time, including but not limited to your credit-card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction), to authenticate your identity, to validate our credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.
 
2.3. Prices
 
Prices shown on the site are in GBP and are inclusive of VAT (where applicable). All prices and offers remain valid as advertised from time to time. The GBP price of a product displayed on the website at the time the order is accepted will be honoured. All orders are subject to our delivery charges, as set out below.
 
2.4. Delivery Charges
 
All orders within the United Kingdom are subject to our standard delivery charge of £3.80 per order. If you require urgent delivery or want to know the status of your order, please contact us on customerservice@littlelollypops.co.uk.

Please note that Saturday, Sunday and Bank Holidays are not classed as working days.
 
2.5. Acceptance of Your Order
 
All orders are subject to acceptance and availability.
 
Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order.
 
Unless you cancel your order in accordance with our cancellation policy below, acceptance of your order and completion of the contract between you and Little Lollypops Ltd will be perfected when we despatch the goods to you. The sale contract is therefore concluding in Bromley, England and the language of the contract is English.
 
We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorisation for payment, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn or that you do not meet the eligibility criteria set-out above.
 
2.6. Payment
 
Payment can be made by Visa, Visa Electron, Master Card and debit cards. Payment will be debited and cleared from your account upon receipt and acceptance of your order by Little Lollypops Ltd. You will not be charged for items that are not in stock or unavailable. You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation check and authorisation by the card issuer.
 
If the issuer of your payment card refused to authorise payment to Little Lollypops Ltd, we will not be liable for any delay or non-delivery.
 
We take all reasonable care to make sure our site is as secure as we can make it.
 
All credit card transactions processed by this site with HSBC are protected with an SSL Secure Server Certificate and 128-bit encryption. This is the de facto standard for creating a secure, encrypted link between a web server and a browser, thus securing safe passage of sensitive information, such as credit card numbers.
 
At Little Lollypops Ltd we do not hold your credit card details on the website in our customer database. All credit card information is processed only by HSBC.
 
Furthermore, we will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Site.

2.7. Insurance
 
Little Lollypops Ltd insures each purchase during the time it is in transit until it is delivered to you. You will be asked to sign for any goods delivered at which point responsibility for your purchased goods passes to you.

3. Cancellation, Returns and Exchanges

3.1. Cancellation
 
Customer satisfaction is our top priority. If you wish to modify, exchange or cancel your order please return our email acknowledging receipt of your order stating your wish to modify or cancel your order.
 
If your order has already been fully processed, it may already have been dispatched , in which case you should follow the returns policy.
 
3.2. Returns & Exchanges
 
If you are not happy with your goods or need to exchange an item for a different size you may cancel your order at any time during the cancellation period. Order cancellation must be made in writing by email to orders@littlelollypops.co.uk quoting order details or by returning our email acknowledgment as stated above. The cancellation period commences as of the date you receive our email acknowledging receipt of your order and ends on the 7th working day following receipt of the merchandise by you or, in the case of gifts, the person who received them.
 
In the event of returns, exchanges or cancellations we require that you return the new and unused goods to us in their original packaging with all original labelling attached. Returns on items such as lingerie and swimwear may not be accepted.
 
Please note: New and unused means that there are no marks on the item or any wear on the tags. We do not sell used items and will not accept any item with any indication that it was used. In such cases, the item will be returned to the purchaser at the purchaser´s cost. Little Lollypops Ltd is not responsible for any item that is no returned in the manner set forth above.
 
We request that all goods are returned within 7 days of the date of your notice of cancellation or return order. After 7 days items may only be returned for an exchange, after 14 days items may not be returned.
 
All goods returned for exchange or refund must be sent to the address provided on the order confirmation e-mail, or the invoice received with your goods.
 
In the event of any failure to return any goods to us within the stipulated time limits even though validly cancelled, we shall have the right to charge any costs of recovery of the goods.
 
Littlelollypops.co.uk will check all items returned as damaged or defective. In the event we find no fault, we reserve the right to re-charge you for the item/s and to recover our fees and expenses from you.
 
Where you are withdrawing from your purchase within the seven working day cooling-off period, and there has been no error on our part, we will refund the cost of the item and the cost of sending the item to you as follows:

• where you are returning an item that was part of a larger order, we'll refund the per-item charge for delivery that you incurred
• where you are returning an entire order, we'll refund applicable per-item delivery charges and the per-delivery charge that you incurred
• we will refund only standard (Airmail) postage charges for items delivered outside the UK
• where we collect an item from you, we reserve the right to recover the costs of collection from you.

Please note we will not refund the cost of gift wrapping, your costs in returning the item to us and other services provided to you in connection with your purchase unless you return the item to us because of an error on our part or because it is defective.
 
For your own protection when returning any items, we suggest that you use Recorded Delivery, as we will not issue refunds for any items that fail to reach us. Your statutory rights are not affected.
 
3.3. Refunds
 
Refunds to you will be made within 30 days of the date return items are received by Little Lollypops Ltd. All undamaged, correctly returned products will be credited to the original purchaser´s credit card excluding delivery charges and recovery costs.

 
4. Privacy Policy

Little Lollypops Ltd is totally committed to protecting the privacy of our site visitors and customers. We will not disclose information about our customers to third parties except where it is a necessary part of providing a service to you e.g. arranging orders to be dispatched to you.

4.2. Checking your details
 
You may verify the details you have submitted to Little Lollypops Ltd by contacting us via email or by post to the address below. Our security procedures mean that we may request proof of identity before we reveal information. This proof of identity will take the form of your email address and password submitted upon registration.
 
We would strongly recommend that you do not use the browser´s password memory function as that would permit other people using your terminal to access your personal information - write it down and keep it somewhere safe.
